These Terms of Service (“Terms”) are an agreement between you and MosoPlay Games Inc. (“MosoPlay Games”, “we”, “us”). They cover this website, MosoNet accounts, MosoBux and other digital items, and our online services. The Spar Kart game is also covered by the Spar Kart End User License Agreement. How we handle personal information is explained in our Política de privacidad.

By creating an account, buying MosoBux or using our services, you agree to these Terms. If you do not agree, do not use the services.

1. Who can use the services

• You must be at least 13 years old to create a MosoNet account. Children under 13 may not create an account or use our online services. If we learn that an account belongs to a child under 13, we will close it and delete its personal information.
• If you are under the age of majority where you live (18 or 19 in most Canadian provinces), a parent or legal guardian must review these Terms with you and must agree to any purchase before you make it. Parents and guardians are responsible for purchases made by their children.
• You may not use the services if the law bars you from doing so or if we previously closed your account for breaking these Terms.

2. Your MosoNet account

• Give accurate information when you sign up, including your date of birth, and keep your email address current.
• Your account is personal. Do not sell, buy, share, rent or transfer it or its login details.
• Keep your password, authenticator app and backup codes safe. You are responsible for activity on your account. Tell us right away through the contact page if you think someone else has accessed it.
• Only link game platform accounts (such as Steam) that you own and control.
• You can request account deletion at any time from your account page.

3. MosoBux and digital items

• MosoBux is a virtual currency used to unlock digital items in MosoPlay Games titles. MosoBux and digital items (such as characters, skins, colours and effects) are a limited, personal, non-transferable, revocable license to use them within our services. They are not personal property and you do not own them.
• MosoBux have no cash or monetary value. They are not money, a deposit, a stored-value card or a payment instrument. They cannot be redeemed or exchanged for cash, refunded (except where required by law) or used outside our services.
• MosoBux and items cannot be sold, transferred, gifted or traded, except through features we officially provide (if any). Buying, selling or trading MosoBux, items or accounts for real money or anything of value outside our services is prohibited.
• MosoBux do not expire while your account is open.
• Bonus, promotional, coupon, referral and creator-reward MosoBux are given free of charge, may have extra conditions and can be withdrawn if they were obtained by mistake, fraud or abuse.
• We may change, rebalance or retire items, prices and game content to keep the games fair and running. If we permanently shut down a service, we will give reasonable notice where possible and follow applicable consumer law.

4. Purchases

• MosoBux are sold on this website. Payments are processed by Stripe; we never receive your full card number. The price, currency and any applicable taxes are shown before you pay.
• MosoBux are delivered to your account right after payment is confirmed. If they do not arrive, contact us.
• MosoBux purchases are final and non-refundable, except where required by law. Nothing in these Terms limits refund or cancellation rights that consumer protection law gives you.
• If you dispute a charge with your bank or card issuer (a chargeback), we may remove the MosoBux and items from that purchase and suspend purchases or the account while the dispute is open. Please contact us first so we can try to fix the problem.
• Creator codes and coupons are optional, can be changed or ended at any time and have no cash value.

5. Rules of conduct

When using our services you must not:

• cheat, use bots, hacks, macros or unauthorized software, or exploit bugs to gain an advantage;
• attack, overload, probe or interfere with our servers, networks or other players’ connections;
• manipulate rankings, matches, tournaments, referrals, coupons or creator codes;
• harass, threaten, impersonate or abuse others, or use hateful or offensive names or content;
• create accounts by automated means, or create accounts to get around a ban or limit;
• break the law or anyone else’s rights.

6. Your content

Content you submit, such as display names, usernames, messages and feedback, stays yours. You give us a worldwide, royalty-free license to host, display and use it to run and improve the services. You confirm you have the right to submit it. We may remove content that breaks these Terms. Ideas and feedback you send may be used without payment or obligation to you.

7. Our intellectual property

The services, games, characters, art, music, software and trademarks belong to MosoPlay Games or its licensors. Apart from the licenses in these Terms and the EULA, no rights are granted to you.

8. Third-party services

Some features rely on other companies, such as Stripe for payments and Steam for game distribution. Their own terms and privacy policies apply to what you do on their services.

9. Suspension and termination

You can stop using the services and request deletion of your account at any time. We may warn, restrict, suspend or close accounts that break these Terms, commit fraud or put the services or other players at risk. When an account is closed for a breach, its MosoBux and items are lost, except where the law says otherwise. We may also close accounts that have had no activity for a long period after giving notice to the account email address.

10. Changes

We may update these Terms. If a change is significant, we will tell you by email or on the website before it takes effect. If you keep using the services after the change takes effect, the new Terms apply. If you do not agree, you can stop using the services and close your account.

11. Disclaimer and limitation of liability

To the extent the law allows, the services are provided “as is” and “as available”, without warranties of any kind, and we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or virtual items. Where the law allows our liability to be limited, our total liability to you is limited to the amount you paid us in the 12 months before the claim. None of this limits rights you have under consumer protection laws that cannot be excluded, including the Quebec Consumer Protection Act for Quebec residents.

12. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, and the courts of Ontario have jurisdiction over disputes. You may also have the benefit of mandatory consumer laws where you live. Please contact us first so we can try to settle any dispute informally within 30 days. If a part of these Terms cannot be enforced, the rest still applies.
